These Terms of Service ("Terms") govern your use of the Botanic Molecules website and the purchase of products from Botanic Molecules, operated by Botanic Molecules Ltd ("Botanic Molecules", "we", "our" or "us").

By accessing our website or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy. If you do not agree, please do not use our website or services.

Nothing in these Terms affects your statutory rights as a consumer, including any rights given to you by the law of the country where you live.

Botanic Molecules makes apothecary-grade products, including pâte de fruit pastilles sold as food supplements.

Our products are intended for adults only.

3. Health information

Our products include food supplements. Our food supplements are not medicines and are not intended to diagnose, treat, cure or prevent any disease or medical condition. Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.

  • Read the label before use and do not exceed the stated daily dose.
  • Consult a doctor or pharmacist before use if you are pregnant, breastfeeding, taking medication, under medical supervision or have a medical condition.
  • Some of our products contain caffeine. They are not recommended for children, or for people who are pregnant or breastfeeding.

4. Products and availability

We make reasonable efforts to ensure that product descriptions, images, prices and availability are accurate. However:

  • our pastilles contain no added colour, so their colour can vary naturally between batches, and colours may also look different on your screen;
  • availability may change without notice;
  • we may update, reformulate or discontinue products at any time;
  • occasional errors may occur, and we may correct them at any time.

5. Orders

When you place an order, you are making an offer to buy products from us. All orders are subject to acceptance and availability. A contract is formed when we confirm that your order has been dispatched.

We may:

  • refuse or cancel an order;
  • limit the quantities purchased;
  • cancel orders we reasonably suspect of fraud, abuse or resale;
  • restrict sales to certain countries where necessary.

If we cancel an order after payment has been taken, we will refund you in full to your original payment method.

6. Prices and payment

Prices are shown in the currency selected at checkout. The price that applies to your order is the price shown when you place it. Prices for future orders may change.

If we make an error in a price, we will contact you before dispatch and you can choose to continue at the correct price or cancel for a full refund.

Payments are processed securely by third-party payment providers. We do not store or have access to your full card details. Accepted payment methods are shown at checkout.

7. Subscriptions

Some products can be bought on subscription. When you subscribe:

  • you authorise us to charge your payment method for each delivery, at the price and on the schedule shown when you subscribed, until you cancel;
  • we will email you before each renewal is charged;
  • you can skip, pause, change or cancel at any time from your account, or by emailing info@botanicmolecules.com. Changes made before your next billing date apply to that order;
  • there is no minimum term and no cancellation fee;
  • if the price of your subscription changes, we will tell you before the change takes effect, and you can cancel before then.

8. Promotions and discounts

From time to time we may offer discount codes or other offers. Unless otherwise stated, promotions cannot be combined, have no cash value, are non-transferable, and may be changed or withdrawn at any time. Promotions are subject to availability.

9. Shipping and delivery

Estimated delivery times are a guide only and are set out in our Shipping Policy. Delays can occasionally occur because of customs processing, carrier disruption, weather, public holidays or other events outside our control.

Risk in the products passes to you when they are delivered to you or to someone you nominate. Ownership passes once we have received full payment.

International orders. Our products are formulated and labelled for the UK, and rules on importing food supplements differ between countries. Please check that our products can be imported and used where you live. Import duties, taxes and customs fees not collected at checkout are your responsibility. If an order is refused or held by customs, we will refund the price of the products once the parcel is returned to us. Delivery costs and any import charges paid cannot be refunded.

10. Returns and refunds

For health and hygiene reasons, we do not accept returns of our products, and we do not accept returns of gift cards. This does not affect your statutory rights, including your right to cancel an unopened order within 14 days of delivery if you live in the UK or the European Union, and your rights if a product is faulty, damaged or not as described.

First-order guarantee. If you are not satisfied with your first purchase, contact us within 30 days of receiving it and we will refund it to your original payment method.

Subscription orders. We do not refund subscription re-orders cancelled after a shipping notification has been sent, except where your statutory rights apply.

11. Resale

Our products are sold for personal use only. You may not resell, redistribute or offer our products for sale, including through Amazon, eBay, TikTok Shop or similar marketplaces, without our prior written consent. We may cancel orders or close accounts where we reasonably believe products are being bought for resale.

12. Intellectual property

All content on this website, including text, images, graphics, logos, product names, packaging design, website design and branding, is owned by or licensed to Botanic Molecules Ltd and is protected by intellectual property law. Botanic Molecules, Wake, Rest and The Pairing are our trade marks.

You may view and print content for your own personal, non-commercial use. You may not copy, reproduce, distribute, modify, publish or exploit any content, frame our website, or use our names or trade marks (including as metatags or search keywords) without our prior written consent.

13. Reviews and content you submit

If you submit reviews, testimonials, photographs, feedback, ideas or other content to us, you grant us a non-exclusive, worldwide, royalty-free licence to use, reproduce, publish, edit for length and clarity, display and distribute that content for marketing and business purposes. We will not change the meaning of a review. You also agree that we may use any ideas or suggestions you send us without obligation to you.

You confirm that any content you submit:

  • is your own, or you have permission to submit it;
  • reflects your genuine experience;
  • discloses clearly if you received payment, free products or any other incentive in connection with it;
  • does not infringe anyone else's rights;
  • is not unlawful, misleading, offensive, defamatory or abusive.

We may remove content that we consider breaches these Terms.

14. Acceptable use

You agree not to:

  • use the website for any unlawful purpose;
  • interfere with the website's operation or security, or attempt unauthorised access to our systems or accounts;
  • upload viruses, malicious software or harmful code;
  • use robots, scrapers or other automated tools to copy or extract content;
  • misrepresent your identity;
  • infringe the rights of any person or organisation.

We may suspend or terminate access for anyone who breaches these Terms.

Our website may contain links to third-party websites or services, provided for convenience only. We are not responsible for their content, privacy practices, products or services, and a link does not imply endorsement.

We aim to keep our website available and accurate, but we do not guarantee that it will always be available, uninterrupted or error-free, or that information on it will always be complete or current.

To the fullest extent permitted by law, Botanic Molecules shall not be liable for any indirect, incidental, consequential, special or punitive damages arising from:

  • delivery delays;
  • third-party services.

Our total liability relating to any claim shall not exceed the amount paid for the product giving rise to the claim.

18. Events outside our control

We are not responsible for delays or failures caused by events outside our reasonable control, including natural disasters, government action, pandemics, transport disruption, internet outages, industrial action or supply chain interruption. If this happens, we will tell you, take reasonable steps to minimise the effect, and you may cancel any affected order for a full refund.

23. Governing law

These Terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live outside the UK, you keep the protection of any mandatory consumer law of your country and may also be able to bring proceedings there.
